Terms of Use


Licence Type A: Where Wellcome Trust is the copyright holder or where copyright holder is not known

The images on this site are, unless otherwise stated, © Wellcome Trust, and in this situation, users may copy, distribute and display the freely downloadable version of the image under the terms of the Creative Commons Attribution-Non-Commercial version 2.0 licence for England & Wales (the "Creative Commons Licence", for details see http://creativecommons.org/licenses/by-nc/2.0/uk/) and the additional conditions set out below.

Where the copyright holder is not known, Wellcome Images makes all reasonable efforts to obtain copyright holders' consent to publish the images represented on this site. Wellcome Images would like to hear from any copyright owners who are not properly identified on this site so that we may make the necessary corrections. Please see the library website for further details.

Summary:

Under the terms of the Creative Commons Licence, anyone is free to copy, distribute, and display the image, providing that the image is fully attributed to Wellcome Images and used solely for non-commercial purposes.

Licence Type B: Where Wellcome Trust acts as agent for the copyright holder

Where Wellcome Trust acts as agent for the copyright holder (Biomedical and clinical collections), users may copy, distribute and display the freely downloadable version of the image under the terms of the Creative Commons Attribution-Non-Commercial No-Derivatives version 2.0 licence for England & Wales (the "No Derivatives Licence", for details see http://creativecommons.org/licenses/by-nc-nd/2.0/uk/) and the additional conditions set out below.

Summary:

Under the terms of the No Derivatives Licence, anyone is free to copy, distribute, and display the image, providing that the image is fully attributed to the creator and Wellcome Images, used solely for non-commercial purposes, and is not altered, transformed, or built upon by the user.

In the case of both Licence A and B, please use the links given above to access the full licence terms (for the Creative Commons Licence or No Derivatives Licence, as applicable), in conjunction with the Additional Conditions given below, which together make up the Terms of Use.

Additional information

Non-Commercial use only
1. 'Non-commercial purposes' is defined under the Creative Commons Licence as not primarily intended for, or directed towards, commercial advantage or private monetary compensation. Please see the list below to see how this applies to you.

Non-commercial covers existing copyright law exceptions, termed 'fair dealing' which includes:

  • private study and non-commercial research
  • criticism and review

in the above this applies only where there are no multiple copies made.

Other uses for which reproduction fees are waived by us for Wellcome-owned images are:

  • examination papers
  • reproduction in an academic publication, being a book, monograph or professional journal article publishing the results of original research, with critical apparatus (notes etc.)
  • thesis submitted by a student at a higher or further education institution for the purposes of securing a degree
  • reproduction in teaching materials created in any medium by a teacher or lecturer at an educational establishment for the purposes of teaching. This includes making printed copies of such materials for students and promoting and making such teaching materials available in electronic form , for example, via a virtual learning environment.
  • use in exhibitions by not-for-profit organisations including accompanying printed catalogue material (not including promotional merchandise offered for sale).
  • personal use by private individuals
  • use in Wellcome Trust funded projects

Derivative works
2. Derivative works are defined under the Creative Commons Licence and No Derivatives Licence as "any work created by the editing, modification, adaptation or translation of the Work in any media". Users are permitted to make derivative works under Licence Type A, but not Licence Type B, but in either case users must also adhere to the conditions relating to attribution and moral rights, as set out below.

Attribution
3. This means that the copyright holder must be credited, and the discreet but visible watermark must be used.

4. The source and licence information will also be embedded in the International Press Telecommunications Council headers which can be viewed by selecting the 'File info' option.

Attribution and derivative works
5. Where derivative works are made from images (under Licence Type A only), in addition to the normal attribution requirements, users must also include the following language:

This image is © Wellcome Images, but has been altered into a Derivative Work by [user's name] by [short description of nature of alteration]

Attribution and moral rights
6. Whichever licence terms apply, users must also consider and uphold the author's statutory moral rights, in particular the author's right not to have his work subjected to derogatory treatment, which means any distortion or mutilation of the work or anything which is otherwise prejudicial to the honour or reputation of the author or creator.

Clinical and sensitive images
7. The Wellcome Trust reserves the right in its absolute discretion to withhold from the terms of this licence either clinical images or those images in its collections where the content is felt to be particularly sensitive, or to respect the person or subject depicted in the image. These images may, however, be licensed to certain individuals and organisations: for more information, please see our clinical images usage terms and conditions.
